Terms of Use

These Terms of Use ("Terms") govern your access to and use of picpopbooths.com (the "Site"), operated by Mejia V&H LLC dba PicPop ("PicPop," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Relationship to the rental agreement

These Terms govern the website only. Any rental of a PicPop photo booth is governed by a separate written rental agreement signed by both parties. In the event of any conflict between these Terms and a signed rental agreement regarding a specific booking, the signed rental agreement controls. Submitting a contact form or requesting a quote on the Site does not create a booking, contract, or obligation to provide service. A booking exists only after a signed rental agreement is executed and the required deposit is received.

2. Site content and intellectual property

All content on the Site — including text, photographs, logos, graphics, layouts, and the "PicPop" name and brand — is the property of Mejia V&H LLC, Jack DeLuca Photography, or its licensors, and is protected by copyright, trademark, and other applicable laws.

You may view and share Site content for personal, non-commercial purposes. You may not:

• Reproduce, republish, or distribute Site content for commercial purposes without written permission
• Use the PicPop name, logo, or brand assets in any way that suggests affiliation, endorsement, or partnership without written permission
• Scrape, copy, or systematically extract content from the Site
• Reverse engineer or attempt to derive source code from any Site functionality

Photos appearing in the gallery and case studies are published with the understanding of the event host or brand client. Featured client logos are displayed to indicate work history, not endorsement of PicPop by those companies.

3. Acceptable use

You agree not to use the Site to:

• Submit false, misleading, or fraudulent information through any form
• Harass, abuse, or threaten any person
• Attempt to gain unauthorized access to the Site, its systems, or any related systems
• Introduce viruses, malware, or other harmful code
• Interfere with or disrupt the Site's operation or any other user's access
• Violate any applicable law or regulation

4. Quotes and pricing

Pricing displayed on the Site (including "starting at" rates) is informational and subject to change without notice. Final pricing is set in a written quote and confirmed in the signed rental agreement. The Site does not constitute a binding offer.

5. Third-party links and services

The Site may link to third-party websites or use third-party services (such as fonts, hosting, or form processing). We do not control and are not responsible for the content, availability, or practices of third-party sites or services. Following any third-party link is at your own risk.

6. Disclaimers

The Site is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Site's accuracy, completeness, reliability, or availability. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Information on the Site is for general purposes and does not constitute legal, financial, or professional advice.

7. Limitation of liability

To the fullest extent permitted by law, Mejia V&H LLC, its members, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the Site, including without limitation lost profits, lost data, or business interruption, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from your use of the Site is limited to one hundred dollars (US$100).

This limitation does not apply to liability that cannot be excluded under California law. Liability arising from a rental booking is governed by the limitations and caps in the signed rental agreement, not these Terms.

8. Indemnification

You agree to indemnify and hold harmless Mejia V&H LLC, its members, employees, contractors, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect information. By using the Site, you consent to the practices described in the Privacy Policy.

10. Changes to the Site or Terms

We may modify the Site or these Terms at any time. When we update these Terms, we will revise the "Last updated" date at the top. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

11. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to the personal jurisdiction of those courts.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
